These terms govern your use of River Rat — the website at riverrat.app and the River Rat app for iOS and Android, operated by Evil Twin Enterprises LLC. By using River Rat, you acknowledge and agree to these terms. In the app, you also accept them on first launch; they remain available here and in the app at any time.
River Rat shows river data — gauge readings, flows, forecasts, weather, and general descriptions of conditions. River Rat is an information tool, not a safety service, a guide, or a recommendation to run any river. We do not inspect rivers, we do not guarantee any reading is current or correct, and we never tell you a river is safe to run. You make every go/no-go decision yourself.
All data is provided "as is," is not independently verified, and may be incomplete, inaccurate, or out of date. Any "ideal range" indicator is general information only — not a guarantee of safety or suitability.
Whitewater paddling, kayaking, canoeing, rafting, and river floating are inherently dangerous and can cause serious injury or death. By using River Rat and going on or near the water, you understand and voluntarily assume all inherent risks — known and unknown — including drowning, cold-water immersion and hypothermia, capsizing, entrapment and pinning (strainers, sweepers, undercut rocks, sieves), rapids, holes and hydraulics, rocks and obstacles, rapidly changing or unexpected flows (including dam releases and flash floods), equipment failure, remoteness and delayed rescue, weather and wildlife, and your own or others’ misjudgment — and including reliance on incomplete, inaccurate, delayed, or unavailable data shown in River Rat.
To the fullest extent allowed by Montana law, you waive and release River Rat and its owners and agents from any injury, death, or damage resulting from the inherent risks above or from ordinary negligence. This does not apply to gross negligence, willful conduct, or fraud, or to anything Montana law does not permit you to waive.
The following statement is required by Montana law (MCA 27-1-753):
By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.
